Terms of Service – HostKea.com
These Terms of Service (the “Agreement”) set forth the terms and conditions of Your Use of hosting and related services (“Services”). In this Agreement “You” and “Your” refer to You as the user of Our Services, or any agent, employee, servant or person authorized to act on Your behalf. “We”, “us” and “our” refer to HostKea.com/dash.hostkea.com., as well as its parent, subsidiaries and sister companies (“FirstVeda”). This Agreement explains Our obligations to You, and explains Your obligations to Us for the various services or products offered by FirstVeda, HostKea (“Services”). When You use Your account or permit someone else to use it to purchase or otherwise acquire access to additional Services or to cancel Your Services (even if We were not notified of such authorization), You signify Your agreement to the terms and conditions contained in this Agreement.
Website Data Loss/Whole Website Data Vanished:
We are not responsible for any/whole website data loss/corruption. Data loss due to hardware failure or in any situation, so always take your website backup in your local drive. Server Upgradation, Software Updation/Testing, Modules Testing/Implementation may happen from time to time. For this purpose sometimes we need to down some services for a certain period. If in case of any upgrade, the customer May or May not be informed 24 hours before the downtime. This kind of downtime will not be counted as Server Downtime. We improve the servers/software/security/modules.
Emails marked as Spam:
Your emails may sometime be marked as Spam or they may land in the Spam folder of receiver’s Email address. This happens when your email is not having correct DKIM, SPF records or if you exceed the daily/hourly outgoing email quota. Also, sometimes big email companies like Gmail, Yahoo temporary blacklist Shared Hosting Server IP addresses. Due to this reason, your emails may land in the spam folder of the receiver’s email address.
Use external email clients like SendGrid to overcome this issue.
Viruses & Other Destructive Activities:
Use of Hostkea’s services or equipment for creating or sending Internet viruses, worms, or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is strictly prohibited.
Malicious Website or Website Hacked:
As you are the owner of your website, it is your responsibility to make your website secure. We will not take any kind of responsibility if your website gets infected or hacked. We have add-on packs to secure your website from our end for one time.
Hostkea services must be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets, or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat or violates export control laws.
System and Network Abuse:
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks; interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
The use of Onohosting.com’s services to store, post, display, transmit, advertise, or otherwise make available any type of pornography is prohibited. If We find any movie/video/Audio/Mp3 then your Account will be Suspend/Terminate without any Notification.
Web Hosting and E-Commerce accounts should not be used to distribute illegal or pirated software/files/information. Hostkea services are provided on an as-is, as available basis without warranties of any kind, either expressed or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Hostkea.com and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
Hostkea, and its parent company, subsidiaries reserve the right to suspend the services if the payments are not made by the due date. We shall not be held liable for any kind of loss due to the disruption of services. Our pricing may increase or decrease at any time or situation if any third party software license price increase or decrease like Softaculous, CloudLinux, LiteSpeed, SiteBuilder, cPanel, Plesk, CWP, etc. In some cases, if third party or base software or application price increases or decreases then existing customers or new customers & whoever will or had purchased our hosting has to pay extra cost expenses because our pricing is dependent on all these third party software licenses.
You can cancel your hosting plan within the first 7 days for a full refund. PayPal Fee will be deducted. Other Payment Gateway transaction charges will be deducted.
1) The money-back-guarantee does not apply to most add-on products like Domains, WordPress Installation, WordPress Themes, Optimization, etc.
2) If you cancel within 7 days and your plan includes free months, HostKea and its Subsidiaries will deduct the fee for Free Months.
3) FirstVeda, HostKea, and its Subsidiaries do not offer any refunds for cancellations that occur after 7 days.
Actions Taken by “Us”:
The failure by a customer to meet or follow any of the terms & conditions is grounds for account deactivation. Hostkea will be the sole arbiter as to what constitutes a violation of the term & condition. Hostkea reserves the right to remove any account without prior notice and to refuse service to anyone at any time. Depending on the severity of the violation, Hostkea may, at its sole discretion, restrict, suspend or terminate a customer’s web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Hostkea will notify the appropriate law enforcement authorities of such violation. Hostkea does not issue credits for outages incurred through service disablement resulting from Term & Condition violations. Hostkea customers agree to indemnify and hold Hostkea harmless from any claims resulting from the use of our services that damages them or any other party.
Customer’s Valid Contact Details:
The customer’s contact details must be complete and correct with the valid phone/mobile number. Our team reviews each and every customer profile and if they find any profile details incomplete or incorrect they may ask the customer to provide valid documentary proof of their identity and address proof e.g. Citizenship proof, Voter ID, Pan Card, Social Security Card, Aadhaar Card or Passport, in case of international customer it must be a Passport only. We may temporarily suspend the customer’s account if their contact details are incomplete or incorrect and if they fail to provide the requested documents, Hostkea may terminate their account and there will not be any refund in that case.
The laws of the Republic of India & the US will govern this agreement. In any event of a dispute, the area of Jurisdiction would be India only & Term & Conditions can be changed without any notification.
